Under the IP Law of Vietnam, industrial design is defined as the external appearance of a product (designs of products invisible in the intended process of utilisation can not be protected) and is represented in three dimensional forms, lines, colors or any combination thereof.

To qualify for protection, an industrial design must be novel on a worldwide basis, involves some level of creative and can serve as a pattern for a product of industry or handicraft. Designs that are purely functional (attributable to technical characteristics or for a technical purpose) cannot be protected.

A design patent becomes effective on the date of issuance. It is valid for a term of 5 years computed from the filing date and may be extended twice for 5 years each.

Vietnam is a member of the Paris Convention and priority claims can be made within 6 months of application in another convention country.
